Workers compensation policy information for the State of Arizona

- State Fund: Arizona maintains a state administered fund who competes with private insurers
- Assigned Risk: NCCI maintains the Arizona Workers Compensation Assigned Risk Plan (AWCARP).
- Numerical Exceptions: None, if an employer has 1 employee they are required to carry workers compensation.
- Individual Waivers Allowed: Yes
- Sole Proprietor: Excluded from coverage/can elect to be included. If included the rating payroll used is a minimum of $600 and a maximum of $3,920 per month as of 1-1-2011. Sole-proprietors and Partners covered only if endorsed on policy.
- Partners: Excluded from coverage/can elect to be included. If included the rating payroll used is a minimum of $600 and a maximum of $3,920 per month as of 1-1-2011. Sole-proprietors and Partners covered only if endorsed on policy.

- Special Notes: LLC Members - Whether workers’ compensation insurance coverage is required for its member-employees depends on how the business has elected to file its taxes. If the L.L.C. or the L.L.P. elects to file IRS Form 8832 choosing to be taxed as a corporation (Form 8832, line 2(a) or 2(d)), then the Industrial Commission will deem the business as being a corporation for workers’ compensation purposes, and it must therefore carry workers’ compensation insurance on its member-employees. On the other hand, if the business has not elected to be taxed as a corporation, the L.L.C. or the L.L.P. will be treated as a partnership for its member-employees, or in the instance of a one-member L.L.C., as a sole proprietorship, and will not be required to carry workers’ compensation insurance on its member-employees.

- Arizonz Workers In Other States; Other States Workers In Arizona; Extraterritorial; Reciprocity; Non-Compliance: When an Arizona worker is working temporarily in another state, workers compensation coverage for that worker is governed by the extraterritorial provisions found in Arizona statutes. When allowed, extraterritorial provisions allow benefits for an injured worker to apply as if the worker was in their primary state. Not all states provide Extraterritorial Provisions. Reciprocity governs coverage for a worker from another state who is working temporarily in Arizona.
