Nebraska Injured Employee Workers Compensation Benefits

Important workers compensation benefit information for injured Nebraska employees

Nebraska Workers Compensation Medical Benefits -

  • The Nebraska employer is liable for all reasonable medical and hospital services, appliances, prescribed drugs, prosthetic devices, and other supplies that are necessary as the result of a work-related injury. Expenses for medical travel for injured Nebraska worker may be paid in some instances.

Who Chooses the Physician for Injured Workers in Nebraska-

  • There are rules about whether the employee or employer chooses the doctor. The Nebraska employee has the right to select a physician who has maintained the medical records of the employee (or an immediate family member) when the employer notifies the employee of this right. If the employee does not have or does not choose such a physician, then the Nebraska employer may select the physician.

Nebraska Workers Compensation Disability Benefits -

  • Temporary Total Disability (TTD) Benefits:
    • Compensation is 66 2/3 percent of the injured Nebraska workers wage.
    • Minimum weekly payment is $49 or the workers actual wage if less.
    • Maximum weekly payment is 100 percent of the Nebraska state average weekly wage which is $671.
    • Maximum number of payments is tied to the length of the disability.
    • Note:
      • Current Montana state average weekly wage is: $671.
      • Compensation benefits begin on the eighth calendar day of disability due to the injury. Compensation for the first seven days of disability is not paid unless the employee's disability lasts six weeks or more.

  • Permanent Total Disability (PTD) Benefits:
    • Compensation is 66 2/3 percent of the injured Nebraska workers wage.
    • Minimum weekly payment is $49 or the workers actual wage if less.
    • Maximum weekly payment is 100 percent of the Nebraska state average weekly wage which is $671.
    • Maximum number of payments is tied to the length of the disability.

  • Permanent Partial Disability (PPD) Benefits:
    • Compensation is 66 2/3 percent of the injured Nebraska workers wage.
    • Minimum weekly payment is $49 or the workers actual wage if less.
    • Maximum weekly payment is 100 percent of the Nebraska state average weekly wage which is $671.
    • Maximum number of payments is tied to the length of the disability.
    • For scheduled injuries the minimum weekly payment is $49 or the injured Nebraska workers actual wage if less.
    • For scheduled injuries the maximum weekly payment is 100% of the Nebraska state average weekly wage, $644.
    • Non-scheduled injuries the maximum period of payments is 300 weeks and the maximum amount payable is $201,300.


Nebraska Workers Death/Dependency Benefits -

  • If the injury results in the death of the employee, the widow/widower is paid death benefits for his or her life or until remarriage. Upon remarriage, the widow/widower receives two years benefits in a lump sum.
  • Benefits are calculated at 66 2/3 percent of the employee's average weekly wage at the time of the injury if there are no children, and at 75 percent if there are children, subject to a maximum and minimum per week.
  • Children are entitled to a percentage of the death benefit until they reach age 19, or age 25 if enrolled full time at an accredited educational institution, or until the end of actual dependency.
  • Burial expenses up to a maximum of $6,000.00 are paid.


Nebraska Workers Compensation Attorney Fees -

  • Fees are limited to 20% - 25% by policy. Nebraska attorney fees may be to the award.
